Gainy Terms of Use

These Terms of Use govern your use of Gainy, an iPhone workout-tracking app. By downloading or using Gainy you agree to them. In plain language: use it sensibly, look after your own health, and we’ll keep the app running as well as we can.

1. Who we are and what Gainy does

Gainy is published by Ongun Labs, an individual developer based in Ankara, Türkiye.

Gainy lets you build workout programs; log sets, weight and reps in Focus Mode; use a rest timer (on the Dynamic Island and as a Live Activity, with a notification); review past workouts through charts, muscle-group breakdown, personal records and estimated 1RM; earn badges; and create images to save or share. It works offline: your data is saved on your iPhone first and syncs to our server when you’re connected.

2. Health disclaimer

Gainy is a tracking tool, not medical advice. Talk to a doctor before starting or changing an exercise program, especially if you have a health condition, an injury, or are unsure whether exercise is safe for you.

Estimated 1RM, progress charts and any progression suggestions are approximate calculations based on what you log. They aren’t guarantees of what you can safely lift. You exercise at your own risk, and you’re responsible for choosing weights and techniques that are safe for you, including any injury that results.

3. Your account and responsibilities

You can use Gainy with Sign in with Apple, or without an account (the app creates an anonymous session). If you use it anonymously and then sign out and delete the app, you can lose access to that data.

Give us accurate information when you choose to, keep your device secure, and remember you’re responsible for what happens under your account or on your device.

4. Gainy Pro subscription

Gainy Pro is an optional, auto-renewing subscription with monthly and annual plans. The details:

  • Pro includes an ad-free experience, advanced share templates and backgrounds, detailed analysis, and PDF report exports.
  • The price is shown in the App Store for your region before you subscribe.
  • Payment is charged to your Apple ID account when you confirm the purchase.
  • The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the end of the current period.
  • You can manage or cancel your subscription in iOS Settings › [your name] › Subscriptions, or with “Manage Subscription” in the app. Cancelling stops future renewals; you keep Pro until the end of the period you’ve already paid for.
  • Refunds are handled by Apple under its own policies. You can request one at https://reportaproblem.apple.com
  • “Restore Purchases” in the app restores your Pro access when you’re signed in to the Apple ID you subscribed with.
  • Deleting your Gainy account does not cancel your subscription. If you have an active subscription, cancel it in iOS Settings first.
  • Apple’s standard Licensed Application End User License Agreement (EULA) applies to Gainy: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

5. Acceptable use

Please don’t:

  • use Gainy for anything unlawful;
  • try to gain unauthorized access to accounts, data or systems that aren’t yours;
  • harm, overload or interfere with our infrastructure;
  • manipulate points, badges or leaderboard statistics.

6. Your data

Your workout data and the content you create in Gainy belong to you. You give us only the limited permission we need to host, process and display it so we can provide Gainy to you. How we handle it is described in the Privacy Policy.

7. Intellectual property and license

The design, code, text, graphics and branding of Gainy belong to us or our licensors, except for your own data. We grant you a personal, limited, non-exclusive, non-transferable license to use Gainy on your Apple devices, subject to these Terms and Apple’s EULA.

8. Third-party services

Gainy relies on services from Apple, Google AdMob, RevenueCat, Supabase and hCaptcha. Their own terms and policies govern their services. Ads are supplied by Google AdMob, and we aren’t responsible for what advertisers say or offer.

9. Availability and changes to the app

We do our best to keep Gainy running well, but we can’t promise uninterrupted availability. Features may change, improve or be discontinued over time.

10. No warranty

To the extent the law allows, Gainy is provided “as is” and “as available”, without warranties beyond those the law requires.

11. Limits on liability

To the extent the law allows, we aren’t liable for indirect, incidental or consequential damages arising from using Gainy, including any injury from exercising. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for intent or gross negligence, or your mandatory rights as a consumer.

12. Ending your use

You can stop using Gainy at any time and delete your account in the app (Profile › Legal and Account) — remember to cancel any active subscription first. We may suspend or close an account if it seriously or repeatedly breaks these Terms, for example through manipulation or unauthorized access.

13. Changes to these Terms

We may update these Terms from time to time. We’ll change the “Last updated” date above. If you keep using Gainy after an update, you accept the updated Terms; if you don’t agree, stop using Gainy and delete your account.

14. Governing law

These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Ankara, Türkiye have jurisdiction, without prejudice to mandatory consumer-protection rules that let you bring a claim where you live (for example before consumer arbitration committees and consumer courts).
